1. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under the age of 18, you represent that you have obtained the consent of a parent or legal guardian to use the App.

2. Account Registration

To access certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at privacy@closurecast.com if you become aware of any unauthorized use of your account.

We reserve the right to suspend or terminate your account at our discretion if we reasonably believe you have violated these Terms or if your account poses a security risk.

3. Subscription Tiers

3.1 Free Tier

The free tier provides access to ClosureCast’s real-time construction zone data across all supported states at no cost. Free-tier users may view active construction zones for any single coverage area (city, county, or state) at a time and search by road name. The free tier does not include saved coverage areas, saved watchlists, push notifications, the future tab, the live map, or other paid features. A free-tier user’s area selection is ephemeral and does not persist between sessions.

3.2 Basic Tier

The Basic tier (currently priced at $5 USD per month or $54 USD per year) includes all free-tier features and adds: one (1) saved coverage area, one (1) saved watchlist (a ZIP code or road), push notifications when new construction matches that watchlist, and access to the future tab (one-week advance planning).

3.3 Plus Tier

The Plus tier (currently priced at $9.99 USD per month or $99 USD per year) includes all Basic features and adds: up to three (3) saved coverage areas, up to five (5) saved watchlists, the live map view, the ability to snooze long-term construction, and four-week advance planning.

3.4 Pro Tier

The Pro tier (currently priced at $19.99 USD per month or $215 USD per year) includes all Plus features and adds: up to five (5) saved coverage areas, up to ten (10) saved watchlists, custom alert rules (by work type, severity, lanes closed, direction, or keyword), eight-week advance planning, event impact data, and priority feature requests.

3.5 Subscription Processing

All paid tier pricing, billing, and cancellation terms are presented at the time of purchase and are processed by the applicable app store (Google Play or Apple App Store) under their terms of service.

3.6 Feature Changes

We reserve the right to modify, add, or remove features from any subscription tier at any time. We will provide reasonable notice of material changes to paid features.

4. Billing, Refunds, and Cancellation

4.1 Billing

All paid subscriptions are billed through the Google Play Store or Apple App Store (“App Stores”). By purchasing a subscription, you agree to the pricing and payment terms presented at the time of purchase. Subscriptions automatically renew at the end of each billing period (monthly or annually) unless canceled before the renewal date. All prices are in U.S. dollars and may include applicable taxes.

4.2 Monthly Subscriptions

Monthly subscriptions may be canceled at any time. Upon cancellation, you will retain your paid-tier access until the end of your current billing period. No partial-month refunds will be issued. Your subscription will not renew after the current period ends, and your account will revert to the free tier.

4.3 Annual Subscriptions

Annual subscriptions are billed as a single payment for a full twelve-month period. While we offer a 7-day cooling-off period for annual subscriptions, all refund requests must be initiated through and approved by the respective App Store. The Company does not have the technical ability to issue refunds directly for in-app purchases. After the 7-day cooling-off period, annual subscriptions are non-refundable for the remainder of the term. If you cancel an annual subscription, you will retain your paid-tier access until the end of your current annual billing period. No prorated refunds will be issued for unused months.

4.4 App Store Refund Policies

Refund requests are ultimately processed by the applicable App Store (Google Play or Apple App Store), and their refund policies may apply in addition to or in place of this policy. We do not directly process payments or issue refunds. To request a refund, you must contact the App Store through which you made your purchase. For Google Play, visit play.google.com/store/account/subscriptions. For Apple, visit reportaproblem.apple.com.

Subscription purchases are processed by the applicable App Store, which acts as the merchant of record. The Company does not have access to or control over payment authorization decisions made by the App Store.

4.5 Founder Pricing Rate Lock

As a commitment to our early subscribers, ClosureCast offers Founder Pricing: subscribers who initiate and maintain a continuously active paid subscription will retain the subscription price in effect at the time of their original purchase for as long as their subscription remains active, even if we increase prices for new subscribers in the future.

The Founder Pricing rate lock is subject to the following conditions:

• The rate lock applies only while the subscription is continuously active. A subscription is considered continuously active if the App Store reports it as active, in good standing, and renewing without interruption.
• If a subscription is canceled, expires, lapses for non-payment, is refunded in full, or is otherwise terminated, the rate lock ends. If the subscriber later chooses to resubscribe, they will be billed at the then-current price for the applicable tier at the time of resubscription, not the original price.
• The rate lock does not apply to tier upgrades. A subscriber who upgrades to a higher tier (or downgrades and later re-upgrades) will be billed at the then-current price for the new tier.
• The rate lock applies to subscription pricing only. It does not guarantee that any specific feature will remain available, and is subject to the feature-change provisions of Section 3.6.

4.6 Price Changes for New Subscribers

We reserve the right to change subscription pricing at any time for new subscribers and for those whose Founder Pricing rate lock has ended under Section 4.5. Any price change for an active continuously-subscribed account will be limited to subscribers who do not qualify for the Founder Pricing rate lock. Where required by the applicable App Store, price changes will be communicated in advance and require affirmative consent before taking effect.

4.7 Free Tier

The free tier does not require payment and does not involve any billing or refund terms. Free-tier users may upgrade to a paid subscription at any time.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable local, state, or federal laws.
• Attempt to gain unauthorized access to the App, other user accounts, or our systems and infrastructure.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
• Interfere with or disrupt the App’s servers, networks, or services.
• Use automated scripts, bots, or scrapers to access the App or collect data from it.
• Submit false, misleading, or spam city requests.
• Circumvent any security measures, rate limits, or access controls implemented in the App.
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
• Use the App to transmit any viruses, malware, or other harmful code.
• Reproduce, distribute, or commercially exploit any content from the App without our prior written consent.
• Use the App or any data obtained from the App to develop, build, or contribute to a competing product or service.

6. Construction Zone Data

6.1 Data Accuracy

The App provides construction zone information for cities and roadways across the U.S. states ClosureCast currently supports (Arizona, Delaware, Florida, Hawaii, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maryland, Massachusetts, Minnesota, Missouri, New Jersey, New Mexico, New York, North Carolina, Ohio, Oklahoma, Texas, Utah, Virginia, Washington, and Wisconsin), with additional states added over time. All data is obtained from third-party sources and public Department of Transportation records, including the federal Work Zone Data Exchange (WZDx) feeds. While we strive to provide accurate and up-to-date information, we do not guarantee the accuracy, completeness, timeliness, or reliability of any construction zone data displayed in the App. Construction conditions can change rapidly and without notice.

6.2 Not a Navigation Service

ClosureCast is an informational planning tool only. ClosureCast is not a navigation, routing, turn-by-turn driving, GPS, or driving-assistance service. ClosureCast is not intended for emergency use or real-time safety decision-making. You should always follow posted road signs, traffic signals, and the instructions of traffic control personnel. You agree not to interact with or operate ClosureCast while actively driving a vehicle. ClosureCast is not responsible for, and ClosureCast (along with its parent company True Tone Mirror LLC) expressly disclaims all liability for, any decisions, actions, routes, detours, or driving behavior you choose based on information shown in the App.

YOU EXPRESSLY ACKNOWLEDGE THAT OPERATING THE APP WHILE DRIVING IS DANGEROUS AND PROHIBITED. CLOSURECAST AND TRUE TONE MIRROR LLC DISCLAIM ALL LIABILITY FOR ACCIDENTS, INJURIES, PROPERTY DAMAGE, LOSS, OR DEATH RESULTING FROM THE USE OF THE APP WHILE OPERATING A MOTOR VEHICLE OR FROM ANY DRIVING DECISIONS INFLUENCED BY THE APP, WHETHER OR NOT YOU WERE OPERATING THE APP AT THE TIME.

6.3 No Liability for Road Conditions

ClosureCast is not responsible for any damages, injuries, delays, missed appointments, lost wages, business interruption, or other losses arising from your reliance on construction zone data displayed in the App. Road conditions, closures, lane configurations, and construction schedules are set by the relevant transportation authorities and contractors and are beyond ClosureCast’s control. Actual conditions on the ground may differ materially from what the App shows. The App is provided strictly “as-is” and “as-available” without warranty of any kind.

7. Intellectual Property

The App, including its design, code, graphics, logos, trademarks, and content, is the property of True Tone Mirror LLC and is protected by United States and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to modify, reproduce, distribute, create derivative works from, publicly display, or commercially exploit any part of the App. This license automatically terminates if you violate these Terms.

8. Push Notifications

By enabling push notifications, you consent to receive alerts about construction zone activity in your selected cities. Notifications are delivered based on your per-city preferences and may include new zone alerts, major closure alerts, ending soon alerts, and digest summaries. You may modify your notification preferences within the App or disable notifications through your device’s system settings at any time. We are not responsible for notification delays caused by third-party services, device settings, or network conditions.

9. Service Availability and Third-Party Dependencies

Certain features of the App rely on third-party data providers, government data feeds, and infrastructure services (including but not limited to state transportation department data, cloud hosting providers, and push notification delivery systems). We are not responsible for interruptions, delays, inaccuracies, or service outages caused by third-party systems beyond our control. We do not guarantee uninterrupted access to the App or continuous availability of construction zone data. Data feeds may be temporarily unavailable, delayed, or contain errors due to upstream provider issues.

ClosureCast acts as an aggregator of public data. ClosureCast is not affiliated with, endorsed by, sponsored by, or an official representative of any government agency or department, including (but not limited to) any state department of transportation, any municipal transportation authority, any city or county public works office, the U.S. Department of Transportation, or any federal, tribal, or local roadway authority. Use of any agency name in ClosureCast or its marketing is solely for the purpose of identifying the source of underlying public data, as required by the relevant agency’s open data terms.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

11. Disclaimers

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE CONSTRUCTION ZONE DATA OR ANY CONTENT PROVIDED THROUGH THE APP.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRUE TONE MIRROR LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON WARRANTY, CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless True Tone Mirror LLC and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you submit or transmit through the App.

14. Termination

We may suspend or terminate your access to the App if you violate these Terms or where reasonably necessary to protect the security or operation of the App. Upon termination, your right to use the App will immediately cease, and we may delete your account and associated data in accordance with our Privacy Policy. Sections 6 (Construction Zone Data), 7 (Intellectual Property), 9 (Service Availability), 11 (Disclaimers), 12 (Limitation of Liability), 13 (Indemnification), and 15 (Governing Law) shall survive any termination of these Terms.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in Bexar County, Texas. You consent to the personal jurisdiction of such courts and waive any objection to venue.

16. Modifications to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App and updating the “Last Updated” date. Continued use of the App after the effective date of updated Terms constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the App and delete your account.

17. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and True Tone Mirror LLC regarding your use of the App.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
• Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
• Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet outages, or third-party service failures.
